These Terms and Conditions ("Terms") govern your access to and use of the Loom24 marketplace platform ("Platform"), operated by OÜ Pecunium Invest (registry code 14971397), a company registered in the Republic of Estonia. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.You must be at least 16 years old to use the Platform. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.2. User Accounts & Responsibilities
To access certain features of the Platform, you must register for an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.You agree to notify us immediately of any unauthorised use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, provided false information during registration, or engaged in fraudulent or illegal activity on the Platform.3. Listings & Content Guidelines
Sellers are solely responsible for the accuracy and completeness of their listings, including descriptions, photographs, pricing, and any claims about the health, breed, age, or condition of animals. All listings must comply with applicable Estonian and European Union laws, including animal welfare regulations.The following content is strictly prohibited: listings for endangered or protected species; animals obtained illegally; misleading descriptions or photographs; content that promotes, organises, advertises, or glorifies animal cruelty or neglect; the abandonment of an animal or its release into the wild where it is not adapted to survive; the organisation of, participation in, or training of animals for fights between animals; the force-feeding of animals other than where strictly necessary on veterinary grounds; the breeding of animals in a manner that causes suffering or significant risk of hereditary disease, deformity, or behavioural disorder; and any other content that violates applicable laws or these Terms.Listings and advertisements for dogs and cats must not present non-medical cosmetic surgical procedures (including ear cropping, tail docking, devocalisation, declawing, and similar mutilations performed without veterinary necessity) as a feature, breed standard, or selling point. We may remove or restrict any listing that promotes such procedures. Listings related to exhibitions, shows, or competitions involving animals subjected to such procedures may be refused in accordance with applicable Estonian animal welfare law.We reserve the right to remove, modify, or restrict any listing at our sole discretion, without prior notice, if we believe it violates these Terms or applicable laws. Repeated violations may result in permanent account suspension.4. Intellectual Property
All content on the Platform, including but not limited to logos, designs, text, graphics, software, and the overall look and feel of the Platform, is the property of OÜ Pecunium Invest or its licensors and is protected by Estonian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.By posting content on the Platform (including listing descriptions and photographs), you grant OÜ Pecunium Invest a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute such content for the purpose of operating and promoting the Platform. You retain ownership of your original content and may remove it at any time by deleting your listings or account.5. Limitation of Liability
Loom24 operates as a marketplace platform connecting buyers and sellers. For animal listings arranged directly between users, we are not a party to the transaction and do not take ownership or possession of any animals. We do not guarantee the accuracy of listings, the quality or health of animals, or the conduct of any user.To the maximum extent permitted by applicable law, OÜ Pecunium Invest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited under Estonian or European Union law.6. Dispute Resolution
If you have a dispute with another user, we encourage you to resolve it directly with that user. Loom24 is not a party to transactions between users and does not act as a mediator or arbitrator in disputes between them. If you have a dispute with the Platform itself, contact our support team at info@loom24.ee.If a dispute cannot be resolved through our support team, consumers in Estonia may file a complaint with the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority. More information is available at https://komisjon.ee/.If the dispute cannot be resolved through alternative dispute resolution, it shall be settled in the courts of the Republic of Estonia, subject to the jurisdiction rules set out in Section 7.7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Any legal proceedings arising out of or relating to these Terms shall be brought exclusively in the courts of Harju County, Estonia.If you are a consumer residing in the European Union, you shall also benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable European Union consumer protection legislation, including the Consumer Rights Directive (2011/83/EU) and the Consumer Sales Directive (2019/771/EU).8.
